Florida Judge to Hear Arguments for Smokable Forms of Medical Marijuana

In January, a Leon County circuit judge is set to hear arguments regarding the ban on smokable medical marijuana. The arguments will help her determine whether to challenge the ban or keep it in place. Judge Karen Gievers will begin hearing the arguments on January 25.

Only alternative forms of medical marijuana, such as oils, vaporizers, pills and tinctures are available to patients, WLRN Miami- South Florida reports. John Morgan filed the lawsuit against the state in July. He says the current law violates the constitutional amendment approved by Florida voters.

The state is asking Judge Gievers to dismiss the lawsuit entirely and is contending that the reason for the ban on smokable forms of medical marijuana is health dangers related to smoking.
